Ephedra Products Linked to Over One Hundred Deaths

There are three billion servings of ephedra consumed yearly, an extremely popular stimulant contained in diet pills and sports drinks. Due to its classification as a food, ephedra is exempt from FDA regulation despite adverse side effects of ephedra received since 1994, linking the supplement to chest pain, myocardial infarction, hepatitis, stroke, seizures, psychosis, and death. The FDA has now collected reports of over 100 deaths due to the use of ephedra-containing products, and consumer advocates and doctors are outraged that the supplement has not yet been banned. Public Citizen consumer group petitioned to have ephedra banned in September 2001, and the decision to instead review all scientific reports on ephedra's safety before ruling on the petition prompted the group to label the HHS and FDA as "cowards" for not taking a more deliberate stance.

The nation's largest selling ephedra-containing product, Metabolife, is now under criminal investigation to determine if Metabolife International and former Metabolife president and co-founder lied when telling the FDA they had not received any reports of adverse Metabolife health effects. The FDA has been trying to collect reports from Metabolife as far back as 1997 but said the company "refused and resisted us every step of the way". A pharmacologist hired by the FDA in 1995 to analyze the sudden increase of deaths and heart problems in teenagers whom had taken ephedra was surprised after he reported his findings to the FDA when the agency did not move quickly to restrict ephedra and largely attributes this to the FDA being "under pressure from the powerful ephedra industry".

Ephedra Ban Comes Too Late; FDA Should Have Acted Much Sooner

Today's announcement by the FDA to ban the dietary supplement ephedra, which comes more than two years after we petitioned the agency to do so, shows the dangerous cowardice of FDA Commissioner Mark McClellan and HHS Secretary Tommy Thompson, who waited to act until receiving reports of more than 155 deaths of ephedra users instead of acting much earlier. All the scientific evidence and legal authority to ban ephedra was in place at the time of our petition, which we filed in September 2001. One reason major manufacturers have stopped selling ephedra is that the companies have become uninsurable because of massive losses in product liability cases. Several weeks ago, the last major manufacturer of ephedra dietary supplements - Metabolife - announced that it would no longer sell ephedra. When we filed our petition, there were reports of 81 ephedra-related deaths. Now, after that number has nearly doubled and very little ephedra is being manufactured, the FDA finally announces a ban. This is an inexcusable dereliction of responsibility by an agency that has acted more like an ephedra sales extension agency than the public health agency it is supposed to be.

More Than 30 Army Deaths Attributed To Ephedra

The U.S. Army has reported that more
than 30 active duty service personnel
have died while taking ephedra products
thus prompting a recent military warning
saying "Ephedra may cause severe
medical problems, even death".

Soldiers were taking ephedra on their
own as an "all-natural" way to get an
edge in their physical training. But
military doctors became alarmed when
a rash of healthy young men some in
their early 20's began dropping dead,
all of them using ephedra products.

Not waiting for a ruling from the FDA,
who has been debating ephedra's safety
for years, Army leaders have taken action
to remove all ephedra products from their bases.

What is Ephedra?

Ephedra is a readily available and legal
herbal supplement. And because it is
classified as an "herb" it is perceived to
be innocuous and doesn't fall under the
much tighter scrutiny by the FDA
that synthetic drugs do.

Although its risks are highly debated,
ephedra is a proven energy booster and
fat burner. It is found in over-the-counter
diet pills and bodybuilding drinks or mixes,
and many of your younger male members at
your fitness center may be using it
as you read this.

It also known as "ephedrine" and "ma huang",
it acts as a stimulant that raises the body's
core temperature and cause irregular
heartbeat, insomnia and elevated blood pressure.
Furthermore, its energy-boosting effects can
dangerously mask signs of fatigue and dehydration.

U.S. Air Force Has Similar Problem

The Army incident follows closely on the
heals of the Air Force Surgeon General
last month issuing a "Notice to Airmen"
on the potential risks associated with any
dietary supplements that contain ephedra.
This motion was precipitated by the death
of a young Air Force member.

"What we know is that this young man took
dietary supplements, including ephedra,"
said Royal Air Force Wing Commander,
Dr. Victor Wallace, "Although there was
insufficient evidence to be causal, the
changes seen in this young man's
cardiovascular system can be
associated with ephedra use."

In response, the Air Force Services
Agency issued a memorandum which
called for services activities to remove
all ephedra related supplements from
Air Force operations.

Response from the Ephedra Industry

The ephedra industry says nobody's
proven what caused the military deaths,
and its own scientific studies show
ephedra is entirely safe.

Industry spokesman Wes Siegner
does say soldiers in rigorous training
programs may want to avoid ephedra
but insists it should be available to
others on base who need it.

"Maybe there are some people on military
bases who should not be taking these products,
" Siegner says. "We'd be happy to try figure
 that out with the military and
educate those people."

Death of Athletes Also
Attributed to Ephedra

Our young servicemen are not
the only ones affected by ephedra;
it has made its way into the sports
locker rooms for year.

On September 3, 2002, 16-year old
Sean Riggins died of heart failure. He
was a Lincoln Illinois Community High
School sophomore athlete who purportedly
took "Yellow Jacket", an ephedra-caffeine
compound that experts blame for his death.
His parents have subsequently launched a
campaign to ban the herbal supplement.

Further studies have shown that more than
70 percent of college athletes and up to 50
percent of high school athletes have taken
some type of performance enhancing supplement.
Despite the fact that both the National College
Athletic Association and more recently, the NFL,
have banned ephedrine supplements,
it is still extensively used.

The NFL ban came after the tragic death
of Minnesota Vikings offensive lineman
Korey Stringer, who succumbed to heat
stroke during pre-season camp. While
autopsy results did not find any evidence
 of ephedra in his body, supplements
containing ephedra were found in his locker.

Today, at least 20 states and the
National Football League are among
those who have banned or restricted
use of ephedrine products.
 
Had we the knowledge we now have,

Kanda may very well have been alive today,

but the

"should haves, could haves,

if only,"

we can't go back and fix what

could have saved her life.

And because,

 I,

 her Mom,

(YES, ME)

watched her, many times purchase

THAT LETHAL DIET PILL BOTTLE OF

STACKERS, METABOLIFE,

I knew what she was ingesting,

but was ignorant

 as to the dangers of this

particular diet pill

and even though the autopsy showed

her blood and urine

to be clean,

I knew her seizures had

to be somehow related to 

""STACKERS""

 

But, never in my worst nightmare,

could I have imagined

that an herb as lethal as

""EPHEDRA""

with all it's horrible side effects

was an active ingredient

in the bottles of diet pills my daughter

had ingested over many months.

Ephedra Ban Lifted

The ban on ephedra has been lifted.

Ephedra is a herb used for hundreds
of years to treat asthma and other conditions.
 Because of its ability to increase metabolism,
it also became popular as an ingredient in diet pills.
Ephedra was taken off the market in April 2004 by
the FDA after safety concerns.
 
OUR DAUGHTER DIED ON
APRIL 13, 2004

One high-profile case involved
Baltimore Orioles pitcher Steve Bechler.
He was 23 years old when he died during spring
training in February 2003. At the time, Bechler
was taking diet pills containing ephedrine -
the active substance in ephedra - to lose some weight.

Many people, me included,
felt a complete ban on the herb
was a harsh and unnecessary move.
Bechler, for instance, had a history
of borderline high blood pressure and
abnormal liver and a family history of heart disease.


Although some media quote the number of deaths due
to ephedra at 155, an FDA-commissioned report in
2003 stated in its final ruling that five deaths
could be attributed directly to ephedra.

To put this number in perspective, about 12 to 17
million people consumed ephedra in 1999, reports the
American Herbal Products Association.
The Nutrition Business Journal estimated that
sales of ephedra in 2002 were $1.25 billion.

Contrast this with the number of people killed each
year because of pharmaceutical drugs.
A study reported that in 106,000 people died in
1994 because of overmedication or
adverse reactions to prescription drugs.

Some might call the FDA misguided.


The ban on ephedra didn't affect the sale
of over-the-counter cold medications such
as decongestants which often contain
ephedrine in synthetic form.

It also sparked worry that this was
a sign of things to come.
The ban of ephedra was the
first time the FDA had
removed a dietary supplement
after a landmark law was
created to supposedly protect
our access to them.
The Dietary Supplement Health
and Education Act (DSHEA),
passed in 1994, amended the
Federal Food, Drug,
and Cosmetic Act of 1938
to change how dietary
supplements are regulated
and labeled. Under the DSHEA,
dietary supplements were
classified as foods and not drugs.

The ban was challenged by
Utah-based Nutraceutical Corporation.
They make an ephedra product with
less than 10 mg of ephedra.
The judge ruled, in accordance with the DSHEA, the FDA
could not
place the burden to prove safety on dietary supplement
manufacturers as it does for drug and device makers.

Instead, the agency "must establish that
(ephedra supplements) pose a significant or
unreasonable risk by a preponderance
of the evidence," Campbell wrote.

Campbell also said that the FDA couldn't
prove this with low doses of ephedra.

Bruce Hough, President of Nutraceutical,
commented the decision “is, in our view,
about protecting the public’s access to safe and
effective dietary supplements and in clarifying
the meaning of the 1994 Dietary Supplement
Health and Education Act (DSHEA).
The Court’s ruling clarifies the steps
FDA must take to comply with the law
in its regulation of dietary supplements.”

Hough continued, “The Court made it clear
that FDA has authority
under DSHEA to remove unsafe
dietary ingredients from the market.
But the Court also clarified that
FDA must follow DSHEA and cannot
treat dietary supplements like drugs
or medical devices. The Court made
other important findings, pointing
out that Congress intended that
dietary supplements be treated
as a subset of foods and,
like other foods, are
 “presumed to be safe.”

It allows the company to
resume selling its whole herb
ephedra (NO FDA CONTROL)
product with less than 10 mg
of naturally occuring ephedrine
alkaloids per daily dose.

Our Firm Settles Another Ephedra Related Death Case

Our firm recently settled the last of many

ephedra-related death cases that we have

investigated over the past few years.

This case involved the death of a 24-year

old Alabama woman.

She died while participating

in correction officer training

exercises after taking

an ephedra- and caffeine-

containing dietary supplement.

We have previously written about other

similar settlements in cases,

the most notable of

which was featured in

People magazine and

involved the death of a

mother during an afternoon

run after ingesting a

Nutraquest ephedra product.

That victim died while

her children looked on.

 

In fact, Nutraquest,

a company which made millions

off its ephedra-based products,

filed for bankruptcy in 2003

as a result of the numerous

personal injury and wrongful

death actions filed against it.

That bankruptcy is only now –

years later – being finalized

with a plan to settle all of those

cases for a total of $34.5 million.

The creditors of the debtor

are expected to approve the plan

to resolve the bankruptcy

in the next few days. Our firm

played a large role in seeing

through the resolution of these

cases, due in large part to

our readiness to try a case

involving the death of an

Army Master Sargeant

who died during his daily

basketball match after

taking a Nutraquest

ephedra-containing product.

 

A common denominator in each

of these cases, regardless

of the manufacturer or

distributor, is the complete disregard

for the safety of consumers.

Not a single one of these

companies adequately tested or

researched the safety

of their products. It was all

about marketing and profits

in the most recent case, which

was brought against a

contract manufacturer,

distributor, and contract packager.

Not only was the product not tested

by any defendant,

but each defendant was adamant

that it had no responsibility

regarding the safety of its

ephedra-containing product.

At least two of the defendants

admitted they were aware of

injuries and deaths that had

been reported from

people ingesting ephedra products.

 

It is frightening to learn that

the regulation of food supplements,

such as ephedra, is grossly inferior

to that of pharmaceutical

products, despite the fact that

many herbal products have properties

 similar to pharmaceuticals.

In fact, current regulations don’t

even require food supplement

manufacturers to test their products

before marketing them. The public

would be shocked to learn that

the FDA has little control over the

herbal supplement industry.

Thus, many of those products

pose potential health risks of a

grave nature. In the case of

ephedra products,

the pharmaceutical properties

of the ephedra alkaloids have

been well known by scientists.

Unfortunately, companies in the

U.S. marketed those dangerous

products to the detriment of

consumers. It is amazing to learn

that many of the companies were

started by individuals with

absolutely no training or experience

in either medicine or science.

In our last case, the main defendant

was a pipe layer and yard

worker who had no experience

in herbal supplements. Nevertheless,

this man started producing multi-vitamins

and eventually

the ephedra product that

killed our client.

 

Ephedra-containing products

have been banned by the FDA

as a result of the numerous

injuries and deaths resulting

from the sale these products.

Our firm is proud to have been

a part of litigation that led to the

ultimate ban of this extremely

dangerous herb. Unfortunately,

a lot of people died as a result

of ingesting ephedra-containing

supplements, including

a beautiful, 24-year old young

lady whose life –

full of promise and happiness –

was cut way too short.
